Collection Process
The management process begins with a meeting between an operating partner and our staff. We discuss which delinquent Joint Interest Billings you would like JIB Recovery Services to manage. We then work with the O'Rourke Law Firm to identify issues that may affect the collection of unpaid obligtions. Issues may include heir transfers, state law, and on-going business relationships. Should it become necessary, we will review the Joint Operating Agreement to ascertain any terms and conditions which may be unique to the non-operating partner. Once the issues are resolved, the O'Rourke Law Firm will make contact with the obligated non-operator to mediate the recovery of the obligations.
If a response is received, the O'Rourke Law Firm will negotiate recovery of the amount due and refer the collection management process back to JRS. If not contact is made by the obligated non-operator, based on assessment of collectability, a lawsuit may be initiated by the O'Rourke Law Firm.
JRS will manage post-judgment and settlement recovery by coordinating payments from the obligated non-operator to our clients and the O'Rourke Law Firm will facilitate recovery by serving post-judgment interrogatories, garnishments, and judgment liens.
Our management objectives are to eliminate your day-to-day involvement in the collection process performed by the O'Rourke Law Firm. Only when settlement is imminent do our clients need to participate. Some clients elect to delegate all settlement authority to JRS and the O'Rourke Law Firm thereby eliminating any further involvement. This allows our clients the ability to focus on their core business and not collection accounting. JRS works on a contingent fee so we get paid upon successful recovery. The O'Rourke Law Firm is paid from our contingency fee, not your recovery.
